Where a debtor is enjoying a stay of enforcement due to military, civil protection or civil defence service, the duration of liability of a mortgage right for the interest of the claim secured by that mortgage right (Art. 818 para. 1 No 3 Swiss Civil Code1) is extended by the duration of the stay of enforcement.2
In debt enforcement proceedings to realise a pledge, the summons for payment must also be served during the stay of enforcement if this has lasted for three months.
