STREET CAR TRACKS, POWER TO CONSTRUCT GRANTED TO SECOND CLASS CITY
Act of Mar. 31, 1915, P.L. 37, No. 21 Cl. 11
AN ACT
Empowering cities of the second class to construct and maintain
street-railway tracks and equipment for the operation of
street-cars, and to lease said tracks and equipment, upon
payment of a reasonable rental, to persons or corporations
desiring to use the same for the operation of street-cars.
Section 1. Be it enacted, &c., That cities of the second
class are hereby empowered to construct and maintain street-
railway tracks, with such curves, switches, connections, and
sidings, and other appurtenances, as may be deemed necessary,
upon streets, alleys, and other highways within said
municipalities, where street-railway tracks have not been laid,
nor has the said municipality authorized the laying of any
tracks thereon by any other person or corporation. Said
municipal corporations may also construct and maintain such
poles, wires, or other overhead, surface, or subsurface
structures, as may be necessary to provide for the operation of
cars over said tracks, by electricity or otherwise.
Section 2. Said municipal corporations are hereby empowered
and authorized to lease said tracks and equipment to other
persons or corporations authorized by law to maintain and
operate street passenger railways, upon such terms and
conditions as may be agreed upon: Provided, however, That the
amount of the annual rental to be paid therefor shall in no case
be less than an amount sufficient to pay all annual maintenance
and renewal charges on account of said construction, and, in
addition thereto, not less than six per centum per annum
interest upon the cost of the construction of said tracks and
equipment.
Section 517. Expiration of Licenses; Renewals.--All licenses
issued under this article shall expire at the close of the
license period, but new licenses for the succeeding license
period shall be issued upon written application therefor, duly
verified by affidavit, stating that the facts in the original
application are unchanged, and upon payment of the fee as
hereinafter provided and the furnishing of a new bond, without
the filing of further statements or the furnishing of any
further information unless specifically requested by the board:
Provided, however, That any such license issued to a corporation
shall expire thirty (30) days after any change in the officers
of such corporation, unless the name and address of each such
new officer of such corporation shall, within that period, be
reported to the board by certificate, duly verified.
Applications for renewals must be made not less than thirty (30)
nor more than sixty (60) days before the expiration of the
license period. All applications for renewal received otherwise
shall be treated as original applications.
