"Consumer lease" means a contract in the form of a bailment or lease for the use of personal property by a natural person primarily for personal, family, or household purposes, for a period exceeding four months and for a total contractual obligation not exceeding $45,000, whether or not the lessee has the option to purchase or otherwise become the owner of the property at the expiration of the lease. Unless the context indicates otherwise, in this chapter "lease" means "consumer lease." "Lessee" means a natural person who leases under, or who is offered a consumer lease.

"Lessor" means a person who regularly leases, offers to lease, or arranges for the lease of personal property under a consumer lease. A person who has leased, offered, or arranged to lease personal property more than five times in the preceding calendar year or more than five times in the current calendar year is subject to the Code and this chapter.

"Open-end lease" means a consumer lease in which the lessee's liability at the end of the lease term is based on the difference between the residual value of the leased property and its realized value.

"Organization" means a corporation, trust, estate, partnership, cooperative, association, government, or governmental subdivision, agency or instrumentality.

"Period" means a day, week, month or other subdivision of a year.

"Person" means natural person or an organization.

"Personal property" means any property which is not real property under the law of the state where it is located at the time it is offered or made available for lease.

"Real property" means property which is real property under the law of the state in which it is located.

"Realized value" means

(A) the price received by the lessor for the leased property at disposition,

(B) the highest offer for disposition, or

(C) the fair market value at the end of the lease term.

"Residual value" means the value of the leased property at the end of the lease term, as estimated or assigned at consummation by the lessor, used in calculating the base periodic payment.

"Security interest" and "security" mean any interest in property which secures payment or performance of an obligation. The terms include, but are not limited to, security interests under the Uniform Commercial Code, real property mortgages, deeds of trust, and other consensual or confessed liens whether or not recorded, mechanic's, materialman's, artisan's and other similar liens, vendor's liens in both real and personal property, any lien on property arising by operation of law, and any interest in a lease when used to secure payment or performance of an obligation.

"State" means any state, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.

"Total lease obligation" equals the total of (1) the scheduled periodic payments under the lease, (2) any nonrefundable cash payment required of the lessee or agreed upon by the lessor and lessee or any trade-in allowance made at consummation, and (3) the estimated value of the leased property at the end of the lease term.

"Value at consummation" equals the cost to the lessor of the leased property including, if applicable, any increase or markup by the lessor prior to consummation.

Subchapter 5 Disclosures

Okla. Admin. Code § 160:10-5-1 General requirements [REVOKED]

History

  • Amended at 9 Ok Reg 2263, eff 6-25-92; Revoked at 17 Ok Reg 1528, eff 5-25-00
Okla. Admin. Code § 160:10-5-1.1 General disclosure requirements

(a) General requirements. A lessor shall make the disclosures required by 160:10-5-1.2, as applicable. The disclosures shall be made clearly and conspicuously in writing in a form the consumer may keep, in accordance with this section. The disclosures required by this chapter may be provided to the lessee in electronic form, subject to compliance with the consumer consent and other applicable provisions of the Electronic Signatures in Global and National Commerce Act (E-Sign Act) (15 U.S.C. § 7001 et seq. ). For an advertisement accessed by the consumer in electronic form, the disclosures required by 160:10-7-1.1 may be provided to the consumer in electronic form in the advertisement, without regard to the consumer consent or other provisions of the E-Sign Act.

(1) Form of disclosures. The disclosures required by 160:10-5-1.2 shall be given to the lessee together in a dated statement that identifies the lessor and the lessee; the disclosures may be made either in a separate statement that identifies the consumer lease transaction or in the contract or other document evidencing the lease. Alternatively, the disclosures required to be segregated from other information under paragraph (a)(2) of this section may be provided in a separate dated statement that identifies the lease, and the other required disclosures may be provided in the lease contract or other document evidencing the lease. In a lease of multiple items, the property description required by 160:10-5-1.2(1) may be given in a separate statement that is incorporated by reference in the disclosure statement required by this paragraph.

(2) Segregation of certain disclosures. The following disclosures shall be segregated from other information and shall contain only directly related information: 160:10-5-1.2(2) through 160:10-5-1.2(6), 160:10-5-1.2(7)(B), 160:10-5-1.2(8)(C), 160:10-5-1.2(9)(A), 160:10-5-1.2(10), and 160:10-5-1.2(13)(A). The headings, content, and format for the disclosures referred to in this paragraph shall be provided in a manner substantially similar to the applicable model form in the appendixes of this chapter.

(3) Timing of disclosures. A lessor shall provide the disclosures to the lessee prior to the consummation of a consumer lease.

(4) Language of disclosures. The disclosures required by 160:10-5-1.2 may be made in a language other than English provided that they are made available in English upon the lessee's request.

(b) Additional information; nonsegregated disclosures. Additional information may be provided with any disclosure not listed in paragraph (a)(2) of this section, but it shall not be stated, used, or placed so as to mislead or confuse the lessee or contradict, obscure, or detract attention from any disclosure required by this chapter.

(c) Multiple lessors or lessees. When a transaction involves more than one lessor, the disclosures required by this chapter may be made by one lessor on behalf of all the lessors. When a lease involves more than one lessee, the lessor may provide the disclosures to any lessee who is primarily liable on the lease.

(d) Use of estimates. If an amount or other item needed to comply with a required disclosure is unknown or unavailable after reasonable efforts have been made to ascertain the information, the lessor may use a reasonable estimate that is based on the best information available to the lessor, is clearly identified as an estimate, and is not used to circumvent or evade any disclosures required by this chapter.

(e) Effect of subsequent occurrence. If a required disclosure becomes inaccurate because of an event occurring after consummation, the inaccuracy is not a violation of this chapter.

(f) Minor variations. A lessor may disregard the effects of the following in making disclosures:

(1) that payments must be collected in whole cents;

(2) that dates of scheduled payments may be different because a scheduled date is not a business day;

(3) that months have different numbers of days; and

(4) that February 29 occurs in a leap year.

Okla. Admin. Code § 160:10-5-1.2 Content of disclosures

For any consumer lease subject to this chapter, the lessor shall disclose the following information, as applicable:

(1) Description of property. A brief description of the leased property sufficient to identify the property to the lessee and lessor.

(2) Amount due at lease signing or delivery. The total amount to be paid prior to or at consummation or by delivery, if delivery occurs after consummation, using the term "amount due at lease signing or delivery." The lessor shall itemize each component by type and amount, including any refundable security deposit, advance monthly or other periodic payment, and capitalized cost reduction; and in motor vehicle leases, shall itemize how the amount due will be paid, by type and amount, including any net trade-in allowance, rebates, noncash credits, and cash payments in a format substantially similar to the model forms in the appendixes of this chapter.

(3) Payment schedule and total amount of periodic payments. The number, amount, and due dates or periods of payments scheduled under the lease, and the total amount of the periodic payments.

(4) Other charges. The total amount of other charges payable to the lessor, itemized by type and amount, that are not included in the periodic payments. Such charges include the amount of any liability the lease imposes upon the lessee at the end of the lease term; the potential difference between the residual and realized values referred to in paragraph (11) of this section is excluded.

(5) Total of payments. The total of payments, with a description such as "the amount you will have paid by the end of the lease." This amount is the sum of the amount due at lease signing (less any refundable amounts), the total amount of periodic payments (less any portion of the periodic payment paid at lease signing), and other charges under paragraphs (2), (3), and (4) of this section. In an open-end lease, a description such as "you will owe an additional amount if the actual value of the vehicle is less than the residual value" shall accompany the disclosure.

(6) Payment calculation. In a motor vehicle lease, a mathematical progression of how the scheduled periodic payment is derived, in a format substantially similar to the applicable model form in the appendixes of this chapter, which shall contain the following:

(A) Gross capitalized cost. The gross capitalized cost, including a disclosure of the agreed-upon value of the vehicle, a description such as "the agreed-upon value of the vehicle [state the amount] and any items you pay for over the lease term (such as service contracts, insurance, and any out-standing prior credit or lease balance)," and a statement of the lessee's option to receive a separate written itemization of the gross capitalized cost. If requested by the lessee, the itemization shall be provided before consummation.

(B) Capitalized cost reduction. The capitalized cost reduction, with a description such as "the amount of any net trade-in allowance, rebate, noncash credit, or cash you pay that reduces the gross capitalized cost."

(C) Adjusted capitalized cost. The adjusted capitalized cost, with a description such as "the amount used in calculating your base [periodic] payment."

(D) Residual value. The residual value, with a description such as "the value of the vehicle at the end of the lease used in calculating your base [periodic] payment."

(E) Depreciation and any amortized amounts. The depreciation and any amortized amounts, which is the difference between the adjusted capitalized cost and the residual value, with a description such as "the amount charged for the vehicle's decline in value through normal use and for any other items paid over the lease term."

(F) Rent charge. The rent charge, with a description such as "the amount charged in addition to the depreciation and any amortized amounts." This amount is the difference between the total of the base periodic payments over the lease term minus the depreciation and any amortized amounts.

(G) Total of base periodic payments. The total of base periodic payments with a description such as "depreciation and any amortized amounts plus the rent charge."

(H) Lease payments. The lease payments with a description such as "the number of payments in your lease."

(I) Base periodic payment. The total of the base periodic payments divided by the number of payment periods in the lease.

(J) Itemization of other charges. An itemization of any other charges that are part of the periodic payment.

(K) Total periodic payment. The sum of the base periodic payment and any other charges that are part of the periodic payment.

(7) Early termination.

(A) Conditions and disclosure of charges. A statement of the conditions under which the lessee or lessor may terminate the lease prior to the end of the lease term; and the amount or a description of the method for determining the amount of any penalty or other charge for early termination, which must be reasonable.

(B) Early-termination notice. In a motor vehicle lease, a notice substantially similar to the following: "Early Termination. You may have to pay a substantial charge if you end this lease early. The charge may be up to several thousand dollars. The actual charge will depend on when the lease is terminated. The earlier you end the lease, the greater this charge is likely to be."

(8) Maintenance responsibilities. The following provisions are required:

(A) Statement of responsibilities. A statement specifying whether the lessor or the lessee is responsible for maintaining or servicing the leased property, together with a brief description of the responsibility;

(B) Wear-and-use standard. A statement of the lessor's standards for wear and use (if any), which must be reasonable; and

(C) Notice of wear-and-use standard. In a motor vehicle lease, a notice regarding wear and use substantially similar to the following: "Excessive Wear and Use. You may be charged for excessive wear based on our standards for normal use." The notice shall also specify the amount or method for determining any charge for excess mileage.

(9) Purchase option. A statement of whether or not the lessee has the option to purchase the leased property, and:

(A) End of lease term. If at the end of the lease term, the purchase price; and

(B) During lease term. If prior to the end of the lease term, the purchase price or the method for determining the price and when the lessee may exercise this option.

(10) Statement referencing nonsegregated disclosures. A statement that the lessee should refer to the lease documents for additional information on early termination, purchase options and maintenance responsibilities, warranties, late and default charges, insurance, and any security interests, if applicable.

(11) Liability between residual and realized values. A statement of the lessee's liability, if any, at early termination or at the end of the lease term for the difference between the residual value of the leased property and its realized value.

(12) Right of appraisal. If the lessee's liability at early termination or at the end of the lease term is based on the realized value of the leased property, a statement that the lessee may obtain, at the lessee's expense, a professional appraisal by an independent third party (agreed to be the lessee and the lessor) of the value that could be realized at sale of the leased property. The appraisal shall be final and binding on the parties.

(13) Liability at end of lease term based on residual value. If the lessee is liable at the end of the lease term for the difference between the residual value of the leased property and its realized value:

(A) Rent and other charges. The rent and other charges, paid by the lessee and required by the lessor as an incident to the lease transaction, with a description such as "the total amount of rent and other charges imposed in connection with your lease [state the amount]."

(B) Excess liability. A statement about a rebuttable presumption that, at the end of the lease term, the residual value of the leased property is unreasonable and not in good faith to the extent that the residual value exceeds the realized value by more than three times the base monthly payment (or more than three times the average payment allocable to a monthly period, if the lease calls for periodic payments other than monthly); and that the lessor cannot collect the excess amount unless the lessor brings a successful court action and pays the lessee's reasonable attorney's fees, or unless the excess of the residual value over the realized value is due to unreasonable or excessive wear or use of the leased property (in which case the rebuttable presumption does not apply).

(C) Mutually agreeable final adjustment. A statement that the lessee and lessor are permitted, after termination of the lease, to make any mutually agreeable final adjustment regarding excess liability.

(14) Fees and taxes. The total dollar amount for all official and license fees, registration, title, or taxes required to be paid in connection with the lease.

(15) Insurance. A brief identification of insurance in connection with the lease including:

(A) Through the lessor. If the insurance is provided by or paid through the lessor, the types and amounts of coverage and the cost to the lessee; or

(B) Through a third party. If the lessee must obtain the insurance, the types and amounts of coverage required of the lessee.

(16) Warranties or guarantees. A statement identifying all express warranties and guarantees from the manufacturer or lessor with respect to the leased property that apply to the lessee.

(17) Penalties and other charges for delinquency. The amount or the method of determining the amount of any penalty or other charge for delinquency, default, or late payments, which must be reasonable. For the purposes of this rule, charges consistent with those enumerated in sections 2-202 and 2-203 of the Code will be presumed to be reasonable.

(18) Security interest. A description of any security interest, other than a security deposit disclosed under paragraph (2) of this section, held or to be retained by the lessor; and a clear identification of the property to which the security interest relates.

(19) Limitations on rate information. If a lessor provides a percentage rate in an advertisement or in documents evidencing the lease transaction, a notice stating that "this percentage may not measure the overall cost of financing this lease" shall accompany the rate disclosure. The lessor shall not use the term "annual percentage rate," "annual lease rate," or any equivalent term.

(20) Non-motor vehicle open-end leases. Non-motor vehicle open-end leases remain subject to §2-311(8) of the Code regarding end-of term liability.

(b) Extension. An extension is a continuation, agreed to by the lessor and the lessee, of an existing consumer lease beyond the originally scheduled end of the lease term, except when the continuation is the result of a renegotiation. An extension that exceeds six months requires new disclosures, except as provided in paragraph (d) of this section.

(c) Assumption. New disclosures are not required when a consumer lease is assumed by another person, whether or not the lessor charges an assumption fee.

(d) Exceptions. New disclosures are not required for the following, even if they meet the definition of a renegotiation or an extension:

(1) a reduction in the rent charge;

(2) the deferment of one or more payments, whether or not a fee is charged;

(3) the extension of a lease for not more than six months on a month-to-month basis or otherwise;

(4) a substitution of leased property with property that has a substantially equivalent or greater economic value, provided no other lease terms are changed;

(5) the addition, deletion, or substitution of leased property in a multiple-item lease, provided the average periodic payment does not change by more than 25 percent; or

(6) an agreement resulting from a court proceeding.

Subchapter 2 Disclosures

Okla. Admin. Code § 160:15-2-1 General disclosure requirements

(a) Form of disclosures.

(1) The creditor shall make the disclosures required by this subchapter clearly and conspicuously in writing and in a form that the consumer may keep. The disclosures shall be grouped together, shall be segregated from everything else, and shall not contain any information not directly related to the disclosures required under 160:15-2-2. The disclosures may include an acknowledgment of receipt, the date of the transaction, and the consumer's name, address, and account number. The creditor's identity and address under 160:15-2-2(1) may be disclosed together or separately from other required disclosures.

(2) The following disclosures required by 160:15-2-2 must be separate from the other disclosures under that section:

(A) The itemization of the amount financed under 160:15-2-2(3).

(B) The customer's description or the distinctive number from customer's driver's license or military identification under 160:15-2-2(11).

(C) A statement to the effect that the customer is not obligated to redeem the pledged goods and that the pledged goods may be forfeited to the pawnbroker thirty (30) days after the specified maturity date, provided that the pledged goods may be redeemed by the customer within thirty (30) days following the maturity date of the pawn transaction by payment of the originally agreed redemption price and the payment of an additional pawn finance charge equal to one-thirtieth (1/30) of the original monthly pawn finance charge for each day following the original maturity date, including the day on which the pledged goods are finally redeemed under 160:15-2-2(14).

(b) Time of disclosures. The creditor shall make disclosures before consummation of the transaction.

(c) Basis of disclosures and use of estimates.

(1) The disclosures shall reflect the terms of the legal obligation between the parties.

(2) If any information necessary for an accurate disclosure is unknown to the creditor, the creditor shall make the disclosure based on the best information reasonably available and shall clearly state that the disclosure is an estimate.

(3) The creditor may disregard the effects of the following in making calculations for disclosure and disclosures:

(A) That payments must be collected in whole cents.

(B) That dates of scheduled payments and advances may be changed because the scheduled date is not a business day.

(C) That months have different numbers of days.

(D) The occurrence of leap year.

(d) Multiple creditors; multiple consumers. If a transaction involves more than one creditor, only one set of disclosures shall be given, and the creditors shall agree among themselves which creditor must comply with the requirements that this rule imposes on any or all of them. If there is more than one consumer, the disclosures may be made to any consumer who is primarily liable on the obligation.

(e) Effect of subsequent events. If a disclosure becomes inaccurate because of an event that occurs after the creditor delivers the required disclosures, the inaccuracy is not a violation of this rule although new disclosures may be required under (f) of this Section or 160:15-2-3.

(f) Early disclosures. If disclosures are given before the date of consummation of a transaction and a subsequent event makes them inaccurate, the creditor shall disclose the changed terms before consummation, if the annual percentage rate in the consummated transaction varies from the annual percentage rate disclosed under 160:15-2-2(5) by more than 1/8 of 1 percentage point.

Okla. Admin. Code § 160:15-2-4 Determination of annual percentage rate

(a) Accuracy of annual percentage rate.

(1) The annual percentage rate for the purpose herein regulating disclosure, but not necessarily for the purpose of rate regulation, is a measure of the cost of credit, expressed as a yearly rate, that relates the amount and timing of value received by the consumer to the amount and timing of payments made. The annual percentage rate shall be determined in accordance with either the actuarial method or the United States Rule method. Explanations, equations and instructions for determining the annual percentage rate in accordance with the actuarial method are set forth in 160:15-2-4(b)(1).

(2) As a general rule, the annual percentage rate shall be considered accurate if it varies in either direction by not more than 1/8 of 1 percentage point from the actual annual percentage rate determined in accordance with (a)(1) of this section.

(b) Computation tools.

(1) The Federal Regulation Z Annual Percentage Rate Tables produced by the Board of Governors of the Federal Reserve System may be used to determine the annual percentage rate, and any rate determined from those tables in accordance with the accompanying instructions complies with the requirements of this section.

Chapter 20 Changes in Dollar Amounts

Okla. Admin. Code § 160:20-1-1 Purpose

The rules in this chapter announce that designated dollar amounts in the Uniform Consumer Credit Code shall change on July 1 of each year when the statutory circumstances have been met.

[14A:1-106(1), (2) and (3)]

(b) The designated sections and the corresponding dollar amounts to become effective on July 1, 1979, are as follows:

1 This reference to §2-104(2)(e) was misdirected. The proper section to which the Legislature intended to affect was §2-104(1)(e). Testimony at the hearing indicated that the mistake was a scrivener's error. It would appear that the dollar limit as to sales of $25,000 was not changed by Senate Bill 231 and House Bill 1156. However, it is noted by the Administrator that the legislative intent in said acts was to raise the dollar amount in sales under the Uniform Consumer Credit Code to $35,000.

Okla. Admin. Code § 160:20-1-20 Calculation method; notices; appendix

(a) Calculation method.

(1) Various dollar amounts set forth in the Uniform Consumer Credit Code shall change effective July 1 of each qualifying year. A "qualifying year" is any year in which the percentage of change, calculated according to the nearest whole percentage point, between the Index at the end of the preceding year and the Reference Base Index is ten percent (10%) or more. [14A:1-106(2)]

(2) The calculations for dollar amount changes use figures from the Consumer Price Index Indicators, Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W), issued each December by Region 6, Bureau of Labor Statistics [14A:1-106(1) and (3)].

(3) The multiplier for calculating dollar amount changes is derived as follows: A minus 138.5 equals B divided by 1.385 equals C. A is the CPI-W All Items for indexes on a 1967 = 100 base, 138.5 is the Reference Base Index, and C is the multiplier.

(4) Each dollar amount for which a change is to be made is to be adjusted as follows: C divided by 100 times D plus D. C is the multiplier and D is the original dollar amount found in the 1969 Uniform Consumer Credit Code.

(b) Notices. When dollar amounts are going to change in July, the Department shall mail a chart with the designated statute sections and the corresponding dollar amounts to all licensed supervised lenders and persons who have made a timely written request for notice of dollar amount changes. The charts shall be mailed no later than April 30 of each year. [14A:1-106(4)(c)]

(c) Appendix. The Department shall mail the dollar amount changes chart to the Secretary of State no later than April 30 of each year. The charts shall be published in the Oklahoma Administrative Code in an appendix to the Department's rules. The charts are exempt from the rulemaking process. [14A:1-106(4)(c)]

Chapter 25 Uniform Consumer Credit Code Rules

Okla. Admin. Code § 160:25-1-1 Purpose

The rules in this chapter provide regulations pursuant to the Uniform Consumer Credit Code, Title 14A of the Oklahoma Statutes, that are not addressed by chapters 10, 20, 45 or 65 of this title.

History

  • Amended at 17 Ok Reg 1583, eff 5-25-00
Okla. Admin. Code § 160:25-1-2 Limitation on garnishment of earnings for pay periods other than a week

(a) For a pay period other than a week, the maximum part of aggregate disposable earnings subject to garnishment to enforce payment of a judgment arising from a consumer credit sale, consumer lease, or consumer loan is:

(1) the amount above $127.50 if an individual's disposable earnings for a workweek or lesser period are more than $127.50, but less than $170.

(2) 25% of an individual's disposable earnings if an individual's disposable earnings for a workweek or less are $170 or more.

(3) the amount above $255 if an individual's disposable earnings for a 2-week period are more than $255, but less than $340.

(4) 25% of an individual's disposable earnings if an individual's disposable earnings for a 2-week period are $340 or more.

(5) the amount above $276.25 if an individual's disposable earnings for a semi-monthly period are more than $276.25, but less than $368.33.

(6) 25% of an individual's disposable earnings if an individual's disposable earnings for a semi-monthly period are $368.33 or more.

(7) the amount above $552.50 if an individual's disposable earnings for a month are more than $552.50, but less than $736.67.

(8) 25% of an individual's disposable earnings if an individual's disposable earnings for a month are $736.67 or more.

(b) The dollar amounts in (a) are based on the federal minimum wage of $4.25 so when the minimum wage increases the proportionate amount of earnings which may not be garnished also increases. To calculate the dollar amount of disposable earnings which would not be subject to garnishment, you multiply the number of workweeks or fractions thereof, by the applicable federal minimum wage and that amount is multiplied by 30. For purposes of this formula, a calendar month is considered to consist of 4 1/3 workweeks.

(c) The date that disposable earnings are paid or payable, and not the date the court issues the garnishment order, is controlling in determining the amount of disposable earnings that may be garnished. If the federal minimum wage increases after the court has issued a garnishment order, then the amounts change for disposable earnings that are paid or payable after the effective date of the increase.
