Chapter 49A-1 ORGANIZATION

The Walton/Okaloosa/Santa Rosa Regional Utility Authority is a public body authorized by Section 373.1962, F.S. It was created by Interlocal Agreement pursuant to Section 163.01, F.S. The counties of Walton, Okaloosa and Santa Rosa and the municipalities of Freeport, Destin, Fort Walton Beach and Gulf Breeze are parties to that Agreement.

Fla. Admin. Code R. 49A-1.002 Purpose

The purpose of the Walton/Okaloosa/Santa Rosa Regional Utility Authority shall be to:

(1) Provide for the planning, design, construction, operation and maintenance of facilities where necessary to insure the availability of an adequate water supply for all public water supply systems within the boundaries of the Regional Utility Authority;

(2) In a like manner, provide for the development of treated sewage effluent disposal and/or reclamation and reuse facilities and solid waste disposal facilities if determined necessary, and insure the availability of these services to all local governments within the boundaries of the Regional Utility Authority;

(3) Give priority to reducing adverse environmental effects of excessive or improper withdrawals of water, and adverse environmental effects of treated sewage effluent and solid waste disposal if needed;

(4) Not deprive, directly or indirectly, any county or city wherein water is withdrawn by the Authority, of the prior right to the reasonable and beneficial use of water which is required to supply the reasonable and beneficial needs of the county or city or any of the inhabitants or property owners therein;

(5) Insure that each member of the Regional Utility Authority shall have preferential right to purchase water and other services of the Authority for use by said member for its reasonable and beneficial needs.

As used in these rules:

(1) “Authority” means the Walton/Okaloosa/Santa Rosa Regional Utility Authority composed of the general voting membership.

(2) “Authority Board” means the Governing Board of the Authority composed of the duly selected representatives of all parties to the Interlocal Agreement.

(3) “Interlocal Agreement” means the Interlocal Agreement made and entered into September 23, 1986, by and between the political subdivision of the State of Florida of Walton, Okaloosa, and Santa Rosa counties, and the cities of Freeport, Destin, Fort Walton Beach and Gulf Breeze, for the purpose of creating the Regional Utility Authority.

Fla. Admin. Code R. 49A-1.004 Membership and Representation

The Authority Board shall be comprised of representatives of the parties to the Interlocal Agreement. Each Board member shall have one vote in all Board actions. Board members shall be selected as follows:

(1) County Representation – Each county represented as a party to the Interlocal Agreement shall appoint two County Commissioners as members of the Authority Board. Each county may also appoint a Commissioner as an alternate representative which shall have the authority to vote in the absence of a primary representative.

(2) Municipal Representation – Each city represented as a party to the Interlocal Agreement shall appoint one City Councilman as a member of the Authority Board. Each city may also appoint a City Councilman as an alternate representative which shall have the authority to vote in the absence of the primary representative.

Fla. Admin. Code R. 49A-1.005 Terms of Authority Board Members

(1) The members of the Authority Board shall serve staggered 3 year terms. The initial appointment for county commissioners shall be for a 3 year term and for city councilmen a 2 year term. All subsequent appointments shall be for a 3 year term. There is no limit as to number of consecutive terms that can be served by any Authority Board member. No Authority Board member shall continue to serve after they cease to serve as an elected representative of their member government.

(2) The balance of the terms of any Authority Board member who resigns or is unable to serve shall be filled in the same manner as prescribed in subsection 49A-1.004(1) and (2), F.A.C.

(3) Members of the Authority Board shall serve without compensation from the Authority.

Fla. Admin. Code R. 49A-1.006 Officers

The officers of the Authority shall be elected by majority vote of the membership and shall serve for terms of 2 years. There shall be no limit on the number of consecutive terms that any officer may serve. The officers, and their respective duties are:

(1) A Chairman, who shall preside at meetings of the Authority Board; sign as authorized by the Authority Board any contracts or other instruments which are deemed to be in the best interest of the Authority; and perform such other duties incident to the office as may be prescribed by the Authority Board.

(2) A Vice-Chairman, who shall act in the Chairman’s absence. The Vice-Chairman shall perform such other functions as the Authority Board may from time to time assign.

(3) A Treasurer, if required, who shall be entrusted with the receipt, care, and disbursement of Authority funds in accordance with fiscal policies and regulations that may be adopted by the Authority Board. Prior to the election of Treasurer, the West Florida Regional Planning Council will serve in this capacity as provided by agreement.

(4) A Secretary, if required, who shall prepare minutes of each meeting and be responsible for distributing copies to members of the Authority Board and shall perform other administrative duties as may be assigned, from time to time, by the Authority Board. Prior to, or in lieu of, the appointment of the Secretary, the West Florida Regional Planning Council will serve in this capacity as provided by agreement.

Fla. Admin. Code R. 49A-1.007 Agenda and Scheduling Meetings and Workshops

(1) General. Meetings and Public Workshops held by the Authority Board of the Authority shall be conducted according to the provisions of this rule section, in lieu of the provisions of Chapter 28-2, F.A.C.

(2) Notice of Meeting or Workshop.

(a) Except in the case of emergency meetings, the Authority shall give at least seven days public notice of any meeting or workshop by publication in the F.A.R.

(b) Such notice of meeting or workshop shall contain:

The date, time and place of the event.
A brief description of the purpose of the event.
The address where interested persons can write to obtain a copy of the agenda.

(c) A meeting, for the purpose of notice herein, is limited to a gathering for the purpose of conducting public business by the Authority Board.

(d) A quorum at any meeting shall be declared when at least six members of the Authority Board are present representing four member local governments.

(e) A workshop, for the purpose of notice herein, is a gathering where the members of the Authority Board are meeting, for the purpose of rule drafting or obtaining information; provided, at which time no official votes may be taken or policy adopted.

(3) Agenda of Meetings or Workshops.

(a) The agenda shall be prepared by the Authority Board in time so that a copy may be received seven days prior to the event by any person who has requested a copy.

(b) The agenda shall list the items in the order they are to be considered. For good cause, items on the agenda may be considered out of their stated order with the approval of the Chairman of the Authority Board.

(c) The agenda shall be specific as to items to be considered. All matters involving the exercise of agency discretion and policymaking shall be listed and summarized on the agenda.

(d) The Chairman of the Authority Board may make specific changes in the agenda after it has been made available for distribution, for good cause shown.

(e) All meetings and workshops shall be open to the public.

(4) Emergency Meeting.

(a) The Authority Board may hold an emergency meeting for the purpose of acting upon emergency matters affecting the public health, safety or welfare. This rule shall not apply to emergency rulemaking.

(b) Whenever an emergency meeting is scheduled to be held, the Authority shall notify one major newspaper of general circulation within its boundaries of the time, date, place and purpose of the meeting.

(c) The Authority shall publish in the first available issue of the F.A.R. following an emergency meeting notice of the time, date and place of the meeting, a statement setting forth the reasons why an emergency meeting was necessary and a statement setting forth the action taken at the meeting.

The Chairman of the Authority Board shall appoint such committees as he deems necessary to carry out the work of the Authority. Committee membership is not restricted to members of the Authority Board. Committee members shall not be compensated by the Authority.

Fla. Admin. Code R. 49A-1.009 Budget and Finance

(1) The Authority Board shall prepare a tentative annual budget for the period October to September 30 and forward copies of same to the governmental bodies of the counties and cities which are parties to the Interlocal Agreement at least four weeks prior to the adoption of a final budget in order that said counties and cities shall have an opportunity to consider action to approve or disapprove the proposed budget. A majority of the Authority Board membership must approve the budget prior to final adoption.

(2) The budget may be amended from time to time by action of the Authority Board.
