825 Alabama Sickle Cell Oversight and Regulatory Commission

Ala. Admin. Code r. 825-X-1-.01 Purpose

The purpose of the organization shall be designated as the agency to insure the delivery of sickle cell services pursuant to Section 22-10B-5, Code of Ala. 1975, to affected persons in all counties in Alabama and assist in establishing geographical service delivery boundaries. The commission shall promulgate guidelines for creating uniformity in the delivery of services and the management of statewide programs. The commission shall allocate the funds from any appropriation by the state for sickle cell treatment and education, and shall be responsible for submitting a consolidated budget and any other financial information required of state agencies, pursuant to the Budget Management Act.

Ala. Admin. Code r. 825-X-1-.02 Membership

(1) Selection. The Commission shall consist of members appointed by and representing the following entities. All appointments must be confirmed by the Senate.

(2) Term. Each member shall serve on the Commission for a period of four (4) years, or until his/her successor is appointed by the appointing entity.

(3) Duties. Each member shall be responsible for regular attendance at meetings of the Commission and shall carry out any task he/she is assigned to carry out as a member of the Commission or any subcommittee thereof.

(4) Vacancies. Upon the resignation, or disqualification of any member, such member shall be replaced as is provided in Section 1 of this Article. Upon resignation of any officer a special election shall be held at the next scheduled meeting.

Ala. Admin. Code r. 825-X-1-.03 Meetings

(1) Regular Meetings. Regular meetings of the Commission shall be held at least four (4) times per year.

(2) Special Meetings. Special meetings of the Commission may be called by the President or Vice President, provided that notice of each such meeting is given as prescribed by these Operating Rules.

(3) Open Meetings. Each meeting of the Commission shall be held in compliance with the Alabama Open Meetings Act.

(4) Quorum. A quorum of the Commission shall be a majority of the currently appointed members. The action of a majority of members present at a meeting at which a quorum is present shall be the act of the Commission.

(5) Voting. Each member shall have one vote. Voting by proxy is not permitted.

(6) Notice of Meetings. Notice of all meetings of the Commission shall be given to members, in writing, at least five (5) days before the date designated for such meeting. The notice shall specify the time and place for each meeting and, to the extent possible, the business to be brought before the Commission.

Ala. Admin. Code r. 825-X-1-.04 Committees

(1) Committees. The Commission may, through its President, establish committees it may, from time to time, deem necessary and appropriate. Any committee so established shall be a standing committee or an ad hoc committee and shall be dissolved upon the completion of the task for which it is established.

Ala. Admin. Code r. 825-X-1-.05 Commission Officers

(1) Officers. The officers shall be a President, Vice President, and Secretary/Treasurer.

(2) Election/Term. The officers shall be elected by majority vote of the members of the Commission and shall serve for a term of four (4) years or until their successors are elected.

(3) President. The President of the Commission shall preside over all regular or special meetings of the Commission, act as liaison between the Commission and its Agencies, act as primary liaison between the Commission and the Federal, State, and local governmental agencies and entities, and appoint committees and act as ex-officio member of each committee.

(4) Vice President. The Vice President shall carry out the responsibilities of the President in his/her absence. He/she shall also carry out any of the assignments delegated to him/her by the President.

(5) Secretary/Treasurer. The Secretary/ Treasurer shall record, sign, and manage the maintenance of all minutes of the Commission meetings, and shall have general charge and supervision of all books and records of the Commission.

Ala. Admin. Code r. 825-X-1-.06 Other Provisions

(1) Day to Day Operations. The Commission has authority to hire persons to assist in handling day to day operations.

(2) Fiscal Year. The fiscal year of the Commission shall commence on the first day of October and end on the last day of September of each year.

(3) Parliamentary Authority. Robert’s Rules of Order, Newly Revised shall be the parliamentary authority for all meetings of the Commission for matters of procedure not specifically addressed by these Operating Rules.

(4) Amendments to Operating Rules. The Commission may amend, revise, alter, or rescind these Operating Rules, in whole or in part, by a simple majority vote of the total number of members present at any meeting, provided that ten (10) days written notice of the intent to amend, revise, alter or rescind is given to each current member of the Commission, along with the proposed and current Operating Rules language.
