660 Alabama Department of Human Resources

Ala. Admin. Code r. 660-3-13-.01 General

(1) Providing for a program for the publishing in newspapers with general circulation throughout the state and posting on the DHR website the names of ten delinquent obligors in any county in support payments.

Ala. Admin. Code r. 660-3-13-.02 Criteria

(1) In order to qualify as a candidate for the Ten Most Wanted Program, the case must meet the following criteria:

(a) There must be a court order of current support.

(b) No court order entered by default is eligible.

(c) The obligor’s location is unknown to the IV-D agency.

(d) The IV-D agency must not have been notified the obligor is involved in bankruptcy proceedings nor have any other agreements prohibiting enforcement actions.

(e) The obligor must not have made a payment or made a payment as a result of income tax refund offset within the previous six months.

(f) The obligor must have known ties to Alabama (i.e. relatives, employment, mailing address).

(g) The obligor must not be a recipient of TANF, SSI, food stamps, or any other type of public assistance.

(h) The amount of arrears must be accurate.

(i) A consent/release form must be signed by the obligee and notarized.

(j) There must be a photograph of the obligor.

Ala. Admin. Code r. 660-3-13-.03 Notification

(1) An obligor who meets the criteria to be a candidate for the Ten Most Wanted Program shall be sent a notification by regular mail to his/her last known address. The Notice shall state that the obligor may avoid being included in the publication by doing all of the following within ninety (90) days after receipt of the Notice:

(a) Make a child support payment that is equal to the amount of support the obligor is required to pay each month under the support order or a percentage of child support arrears owed by the obligor, whichever amount is greater; and

(b) Provide the IV-D agency a current address; and

(c) Provide the IV-D agency proof of employment, current wages, salary, and other compensation; and

(d) Provide the IV-D agency with proof that the obligor has arranged for withholding from the obligor’s wages, salary, or other compensation to pay support and for payment of arrearages.

(2) The Notice shall also inform the obligor of his/her responsibility for the cost of including his/her case in the Ten Most Wanted Program. The cost will be collected after the obligor pays current child support and arrears due.

(1) The IV-D agency shall distribute for publication in newspapers with general circulation throughout the state and post on the DHR website at a minimum of twice per year or monthly as deemed appropriate by the agency, the obligors who are to appear in the publication.

(2) The cost for publication will be placed with the obligors included in the publication.

NOTICE OF INTENT TO PUBLISH YOUR PICTURE IN STATEWIDE NEWSPAPERS AND ON THE DEPARTMENT OF HUMAN RESOURCES, CHILD SUPPORT ENFORCEMENT DIVISION WEBSITE

Pursuant to Act 2000-322, which became state law on October 1, 2000, the Department of Human Resources, Child Support Enforcement Division, has established a program for the publishing in newspapers with general circulation throughout the state and posting on the DHR website the names of ten obligors in any county who are delinquent in their child support payments. Your name has been referred as a possible candidate for this publication. This means the Department may publish your photograph in newspapers throughout the State of Alabama and on the Department of Human Resources, Child Support Enforcement Division website as a result of failure to pay court ordered child support. Our records indicate you are not in compliance with your court ordered child support obligation(s). Further, the records of the Department of Human Resources indicate that you owe $_____ representing past due child support which includes interest as of _____.

You must contact the _____ County Department of Human Resources to show cause as to why you should not be included in this publication. In addition, if you do all of the following within ninety (90) days of receipt of this notice you may avoid having your photograph published:

  1. Make a child support payment to the County Department of Human Resources, Child Support Enforcement Unit, that is at least equal to the amount of support you are required to pay each month under the support order or twenty five percent (25%) of child support arrears, whichever amount is greater;

  2. Provide the County Department of Human Resources, Child Support Enforcement Unit with your current address;

  3. Provide the County Department of Human Resources, Child Support Enforcement Unit with verification of your place of employment, current wages, salary, and other compensation; and

  4. Provide the County Department of Human Resources, Child Support Enforcement Unit with proof that you have arranged for your wages to be withheld to pay your court ordered child support.

Should you fail to respond to this notice and comply with the above listed terms, your name will be submitted as a candidate for the Ten Most Wanted program. If your photograph is published, you will be charged the cost of publication. The cost of publishing your photo in statewide newspapers will be collected only after your child support debt has been satisfied.

If you are currently paying your debts under a bankruptcy plan or if you are complying with court ordered terms for repayment of arrearages, please contact the County Department of Human Resources, Child Support Unit to insure that your case is updated with this information as this notice should not apply in your case.

The Department of Human Resources, Child Support Enforcement Division is authorized by law (Act 2000-322) to publish a list of “Ten Most Wanted” obligors who are delinquent in their child support payments. This list will be published in statewide newspapers a minimum of twice per year and also published on the Department of Human Resources, Child Support Enforcement Division website. The obligor (noncustodial parent) in your child support case appears to meet all of the criteria as a candidate and we would like your permission to publish his/her photograph in statewide newspapers and on our website. This effort is being made with the hope of locating obligors who are difficult to find and have refused to support his/her child(ren) as ordered by the courts.

Please complete the enclosed “Consent/Release Form” if you would like the Department to proceed. Please provide a photograph of the obligor and attach it to the form. If the obligor is in the photo with others, draw a circle around him/her to insure the correct individual is used in the publication. We regret that we are not able to return photographs submitted.
