530 Alabama Liquefied Petroleum Gas Board

By Acts 1965, No. 220, p. 305§2, and Acts 1979, No. 79-435, p.690, the Alabama Liquefied Petroleum Gas Board was established to carry out the provisions of Code of Ala. 1975, §§9-17-101 through 9-17-110 and 40-17-160 through 40-17-166.

Ala. Admin. Code r. 530-X-1-.02 Administration

The Alabama Liquefied Petroleum Gas Board laws are administered by the administrator who is appointed by the Liquefied Petroleum Gas Board. The Liquefied Petroleum Gas Board is located at 7480 Halcyon Pointe Building 3, Suite 100, Montgomery, Alabama 36117. [Telephone: (334) 241-8887].

Ala. Admin. Code r. 530-X-1-.03 Declaratory Rulings

The Board may issue declaratory rulings to any person substantially affected by a rule with respect to the validity of the rule, or with respect to the applicability to any person, property, or state of facts of any rule or statute enforceable by the Board, or with respect to the meaning and scope of any order of the Board. Ala. Admin. Code r. 530-X-1-.04 Petition For Adoption Of Rule

Any person who wishes to propose that the Liquefied Petroleum Gas Board adopt, amend, or repeal any rule shall submit said proposal in the following form:

The Board shall consider the petition, and shall within ninety (90) days after review of the petition, either deny the petition in writing on the merits, stating its reasons for the denial, or initiate rule-making proceedings in accordance with Code of Ala. 1975, §41-22-5.

Ala. Admin. Code r. 530-X-1-.05 Request Public Records From The Alabama Liquefied Petroleum Gas Board

Public records may be requested in writing using the Board's public records request form. Questions may be directed to the Administrator. The public request form will be made available on the Board's website. A fee shall be assessed for costs incurred for searching and producing records as described in rule 530-X-1-.05. Records request will be categorized as either Standard records or Time-intensive records. The Board shall acknowledge all request within two (2) business day of receipts. The Board will provide records, provided that the request has been submitted on the Board approved form and all fees are paid in full. The Board reserves the right to review and/or deny any records request that compromises legally protected information or to which the release of said records would be detrimental to the public. Standard-Records - are designated as public records that are easily made available to the public with little or no preparation time and with limited redaction needed to withhold legally protected information. These requests should be processed within fifteen (15) days, the requestor will be notified by the Board within fifteen (15) days. Time-Intensive Records - are designated as records that would involve more than eight (8) hours of preparation with need for review and redaction with regards to legally protected information. These requests should be processed within forty-five (45) days of receipts. If the Board is unable to process the request within forty-five (45) days, the requestor with be notified by the Board within forty-five (45) days.
