ORDER
Appellant filed his notice of restricted appeal in this case on August 29, 2026.
To date, the filing fee of $205.00 has not been paid by appellant. No evidence that
appellant is excused by statute or the Texas Rules of Appellate Procedure from
paying costs has been filed. See Tex. R. App. P. 5.
Furthermore, the clerk responsible for preparing the record notified this court
that appellant has not made arrangements to pay for the record. As mentioned

previously, no evidence that appellant has established indigence has been filed. See
Tex. R. Civ. P. 145.
This court notified appellant on September 14, 2026 that this appeal was
subject to dismissal without further notice unless he paid the filing fee by September
24, 2026. And similarly, on October 1, 2026, this court notified appellant that this
appeal was subject to dismissal unless he filed a response with proof of payment for
the record by October 16, 2026. See Tex. R. App. P. 4.1(a). No response was filed
in response to either of those notices. Therefore, the court issues the following
orders.
Accordingly, appellant is ordered to pay the filing fee in the amount of
$205.00 to the clerk of this court within ten (10) days of the date of this order. If

want of prosecution. See Tex. R. App. P. 42.3(b).
Appellant is further ordered to demonstrate to this court within ten (10) days
of the date of this order arrangements have been made to pay for the clerk’s record.
See Tex. R. App. P. 35.3(c). If appellant fails to do so, this appeal is subject to
dismissal without further notice for want of prosecution.
