NUMBER 13-26-00595-CV COURT OF APPEALS THIRTEENTH DISTRICT OF TEXAS CORPUS CHRISTI – EDINBURG SHAWN KEITH BICE, Appellant, v. SONMO, LLC, Appellee. ON APPEAL FROM THE COUNTY COURT AT LAW NO. 5 OF NUECES COUNTY, TEXAS MEMORANDUM OPINION Before Chief Justice Tijerina and Justices Cron and Fonseca Memorandum Opinion by Justice Fonseca Appellant Shawn Keith Bice appeals the trial court’s judgment of eviction signed on August 24, 2026. On September 8, 2026, we partially granted appellant’s amended “Emergency Motion for Temporary Relief and Stay of Enforcement Pending Appeal” and ordered the judgment temporarily stayed. See TEX . R. APP . P. 29.3. Appellee SONMO, LLC filed a response asserting that (1) the eviction judgment can no longer be superseded
2 because ten days have elapsed since its entry, see TEX . P ROP . CODE § 24.007, and (2) the appeal is moot because appellant has already vacated the premises. Accordingly, on September 22, 2026, we vacated our temporary stay, denied appellant’s motion for stay, and notified appellant that the appeal will be dismissed for want of jurisdiction unless he files a response within ten days showing that the appeal is not moot. See Marshall v. Hous. Auth. of City of S.A., 198 S.W.3d 782, 787 (Tex. 2006) (noting an appeal in a forcible-detainer case becomes moot when the appellant no longer possesses the property unless the appellant holds and asserts a meritorious claim of right to current actual possession of the property). More than ten days have elapsed since our September 22, 2026 order, and appellant has not filed a response or otherwise demonstrated to this Court that the appeal is not moot. Accordingly, we conclude that the appeal is moot and that we therefore lack jurisdiction over the appeal. See id. The appeal is hereby dismissed for want of jurisdiction and for appellant’s failure to comply with a court order requiring a response or other action within a specified time. See TEX . R. A PP . P. 42.3(a), (c). YSMAEL D. FONSECA Justice Delivered and filed on the 22nd day of October, 2026.
