NUMBER 13-26-00611-CV COURT OF APPEALS THIRTEENTH DISTRICT OF TEXAS CORPUS CHRISTI – EDINBURG SUJATA GOPAL KRISHNAN, Appellant, v. S. GOPAL KRISHNAN, M.D., Appellee. ON APPEAL FROM THE 430TH DISTRICT COURT OF HIDALGO COUNTY, TEXAS ORDER OF ABATEMENT Before Justices Silva, Peña, and West Order Per Curiam This cause is before the Court on appellant’s motion for consideration of changed circumstances and statement of inability to afford payment of court costs. Upon review of the motion and attached statement of inability to afford payment of courts costs, it appears appellant asserts a changed circumstance and is now claiming indigence. However, it is unclear whether the trial court made previous determinations on the matter of indigency and whether appellant’s circumstances have changed.
2 Accordingly, we carry appellant’s motion, abate the appeal, and remand the case to the trial court for further proceedings. Upon remand, the trial court shall immediately cause notice of a hearing to be given to all parties and the court reporter and, thereafter, conduct a hearing to determine the following: 1. Whether the appellant is now indigent; 2. Whether appellant is entitled to a free appellate record due to indigency; and 3. Whether appellant has been provided with a copy of the appellate record. If the trial court determines that appellant is indigent and entitled to a free appellate record, the trial court shall make any orders necessary to ensure such appellant has the opportunity to fully examine the appellate record. The trial court shall cause its findings and recommendations, together with any orders it enters regarding the aforementioned issues, to be included in a supplemental clerk’s record. Furthermore, the trial court shall cause a supplemental reporter’s record of any proceedings to be prepared. The supplemental clerk’s record and supplemental reporter’s record, if any, shall be filed with the Clerk of the Court on or before the expiration of forty-five days from the date of this order. PER CURIAM Delivered and filed on the 21st day of October, 2026.
