NUMBER 13-26-00720-CV
COURT OF APPEALS
THIRTEENTH DISTRICT OF TEXAS
CORPUS CHRISTI – EDINBURG
IN RE DARWIN J. DARILEK AND PAULETTA J. DARILEK
ON PETITION FOR WRIT OF MANDAMUS
ORDER
Before Justices Silva, Peña, and West
Order Per Curiam
Relators Darwin J. Darilek and Pauletta J. Darilek have filed a petition for writ of
mandamus asserting that: (1) the district clerk has a clear ministerial duty under Texas
Rule of Civil Procedure 99(a) to issue citation upon relators’ request and has failed to do
so; and (2) this failure entitles relators to a writ of mandamus compelling performance of
that duty. This original proceeding joins an appeal pending in this Court in our cause
number 13-25-00631-CV, Darwin J. Darilek and Pauletta J. Darilek v. George Ely Fort et
al.
We order the real parties in interest, Meagan Campion, RE/MAX LLC, George Ely
2
Fort and Charlene Fort, and any others whose interests may be affected by the relief
sought, to file a response to the petition for writ of mandamus on or before the expiration
of ten days from the date of this order. See TEX . R. A PP . P. 52.2, 52.4, 52.8.
PER CURIAM
Delivered and filed on the
21st day of October, 2026.
