1 STATE OF RHODE ISLAND AND PROVIDENCE PLANTATIONS PROVIDENCE, SC. SUPERIOR COURT ADMINISTRATIVE ORDER 2020-06 In order to ensure the continuation of Superior Court business while also safeguarding court users and court personnel, the expansion of remote hearings and conferences shall remain a priority. Public access to court proceedings will continue to be available through YouTube streaming and all scheduled hearings and associated YouTube channels shall be posted on the Judiciary website. IN-PERSON HEARINGS Non-emergency matters that cannot be handled remotely shall be conducted in-person on a limited basis. Calendars will be staggered to ensure compliance with the courthouse and courtroom capacity limits and the social distancing guidelines set forth in Supreme Court Order No. 2020-12. Judicial Officers shall ensure that courtroom capacity levels are adhered to and that social distancing and face mask protocols are respected. Commencing June 1, 2020 in Providence County, a Miscellaneous Criminal Calendar and a Trial/Pre-Trial Calendar will be added to the existing calendars that have operated continuously since emergency operations began on March 16, 2020, namely the Daily Criminal Calendar, Pre-Arraignment Conference (PAC) Calendar and Civil Calendar. In Kent County, a Newport/Washington County Criminal/Civil Calendar will be established and will conduct business until such time that the Murray and McGrath Courthouses are reopened. Video conferencing with defendants at the Adult Correctional Institution should continue to be utilized wherever practicable on the Providence and Kent County Daily Criminal Calendars and the Providence County PAC Calendar. For in-person hearings, calendar events will be staggered throughout the day to meet social distancing requirements. Adult Drug Court and Diversion calendars will resume on a limited basis the week of June 15, 2020. For proper distancing purposes and gathering restrictions, specific courtrooms in Providence County and Kent County will be used for the duration of this Order and are noted on the attached Duty Justice and Magistrate assignment list. GRAND JURY Grand Jury proceedings may recommence the week of May 18, 2020 provided that suitable social distancing and precautionary measures are implemented to ensure the safety of jurors, attorneys, witnesses and personnel. CRIMINAL AND CIVIL JURY TRIALS All Criminal and Civil Jury Trials scheduled to commence between March 16, 2020 and July 31, 2020 shall be continued to a date no earlier than August 1, 2020 at which time trial protocols will be reviewed.
2 BENCH TRIALS – CRIMINAL AND CIVIL All criminal and civil bench trials are continued to a date no earlier than July 1, 2020 unless explicitly authorized by the Presiding Justice. COVID -19 RELATED CALENDAR PROTOCOLS/ORDERS All calendar protocols/orders issued in response to the Covid-19 pandemic as well as any modifications or amendments, thereto shall remain in full force and effect. ACCESS TO CLERKS’ OFFICES Clerks’ offices shall continue to conduct court business in all emergency and non-emergency matters, including accepting the filing of pleadings and other documents, scheduling hearings, and issuing orders. Beginning, June 1, 2020 pro se litigants may submit filings via email to the clerk’s office. Email information for each county will be made available on the Judiciary website. Also, effective June 1, 2020, except for emergency matters all in-person filings or business with Clerks’ Offices must be made by appointment only. Instructions on scheduling an appointment and telephone contact information for each county Clerk’s Office will be made available on the Judiciary website. DUTY JUSTICE AND MAGISTRATE ASSIGNMENTS In support of the matters that will be heard from May 18, 2020 through June 30, 2020, in Providence and Kent Counties (including the Newport and Washington County matters) please refer to the attached Duty Justice and Magistrate assignment list.
