A-W Bennett Enterprises, Inc. v. Custom Trailerwerks, Inc. (S057323)(alternative
writ of mandamus allowed June 4, 2009 (346 Or 259)). It appears from the rec-
ord that relator is in default for failure to serve and file the opening brief. It
further appears that on August 19, 2009, the parties were given notice that
this petition for writ of mandamus would be dismissed pursuant to ORAP 1.20
unless good cause was shown within 14 days from that date why the petition
for writ of mandamus should not be dismissed. As of this date the opening brief
has not been filed, therefore, the petition for writ of mandamus is dismissed.
Petition for writ of mandamus dismissed.
