Upon consideration by the court. In the case listed below, the petition for
review is allowed in part and denied in part. The review regarding liabil-
ity for court-appointed attorney compensation and expenses is allowed.
The petition for review is denied concerning all other issues. The decision
of the Court of Appeals regarding liability for court-appointed attorney
compensation and expenses is reversed. The judgment of the circuit court
is affirmed in part and reversed in part, and the case is remanded to the
circuit court for further proceedings in light of Bacote v. Johnson, 833 Or
28, 85 P3d 1019 (2001).
