By order of April 28, 2025, the application for leave to appeal the December 6, 2024
judgment of the Court of Appeals was held in abeyance pending the decision in Swoope v
Citizens Ins Co of the Midwest (Docket No. 166790). On order of the Court, the case
having been decided on March 10, 2026, ___ Mich ___ (2026), the application is again
considered. It appearing to this Court that the case of VHS of Michigan, Inc v State Farm
Mut Auto Ins Co (Docket No. 167464) is pending on appeal before this Court and that the
decision in that case may resolve an issue raised in the present application for leave to
appeal, we ORDER that the application be held in abeyance pending the decision in that
case.
