PEOPLE OF THE STATE OF MICHIGAN,
Plaintiff-Appellee,
v
ERIC THOMAS GILMOUR,
Defendant-Appellant.
SC: 168798
COA: 375661
Mackinac CC: 24-004434-FC
_________________________________________/
By order of December 29, 2025, the plaintiff was directed to answer the application
for leave to appeal the June 24, 2025 order of the Court of Appeals. On order of the Court,
the answer having been received, the application for leave to appeal is again considered.
Pursuant to MCR 7.305(I)(1), in lieu of granting leave to appeal, we REMAND this case
to the Court of Appeals for consideration, as on leave granted, of the defendant’s challenge
to the proportionality of his sentence. In all other respects, leave to appeal is DENIED,
because we are not persuaded that the remaining question presented should be reviewed by
this Court.
