Court of Appeals, State of Michigan
ORDER
AUTO-OWNERS INSURANCE COMPANY V KIMBERLY VANDERWULP
Docket No. 382522
LC No. 24-001051-NF
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction because it was not timely filed.
MCR 7.204(A). The claim of appeal was not filed within 21 days after entry of the final order appealed
from, MCR 7.204(A)(1)(a), and the motions for postjudgment relief were not filed within the initial 21-
day appeal period or “within any further time that the trial court [] allowed for good cause during that 21-
day period,” MCR 7.204(A)(1)(d) (emphasis added). While the trial court allowed for the late filing of
the postjudgment motions in this case, it did not do so based on good cause during the initial 21-day appeal
period. Therefore, appellant could not time the filing of the claim of appeal from the orders denying the
late-filed, postjudgment motions. MCR 7.204(A)(1)(d). Dismissal is without prejudice to the filing of a
late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules
and is not time-barred.
