Judges
The motion to withdraw is DENIED for reasons that the appeal is not wholly frivolous.
Counsel for defendant-appellant shall have 35 days from the Clerk’s certification of this order within
which to file a brief in support of the application for leave to appeal addressing, at minimum, the following
issues:
(1) whether the trial court had authority to impose the consecutive sentences that it
did in this case, see MCL 768.7b; People v St John, 230 Mich App 644, 646; 585 NW2d
849 (1998);
(2) if so, whether the trial court stated a sufficient independent justification as to
each of the consecutive sentences that were imposed, see People v Norfleet, 317 Mich App
649, 664-665; 897 NW2d 195 (2016); and
(3) regardless, whether the imposition of the nonmandatory consecutive sentences
in this case constituted an abuse of discretion, see id. at 664.
