Judges
The motion to waive fees is GRANTED for this case only.
To the extent defendant seeks delayed leave to appeal the trial court’s January 6, 2025
order, the delayed application is DISMISSED for lack of jurisdiction. Defendant did not file the
application within six months of the date of entry of this order. Further, and even applying the prisoner
mailbox rule, MCR 1.112, defendant’s motion for reconsideration was not filed within 21 days of January
6, 2025. Accordingly, the order denying reconsideration cannot be used to extend the time to seek delayed
leave to appeal from the January 6, 2025 order itself. MCR 7.205(A)(4)(a); MCR 7.205(A)(1).
To the extent defendant seeks delayed leave to appeal the trial court’s September 24, 2025
order denying his motion for reconsideration, the delayed application is DENIED for lack of merit in the
grounds presented.
