Court of Appeals, State of Michigan
ORDER
AMY BLOOM V ERIC OGILVIE
Docket No. 381749
LC No. 11-004212-DM
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction. The July 6, 2026 order denying
a motion for reconsideration, from which the claim of appeal is literally taken, is not a final order
appealable of right. MCR 7.202(6)(a); MCR 7.203(A). And the claim of appeal cannot be saved by
treating it as taken from the underlying June 3, 2026 order denying appellant’s motion for parenting time
because that order also is not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). While
an order in a domestic relations action granting or denying a motion to change legal or physical custody
of a minor is a final order under MCR 7.202(6)(a)(iii) there is no such provision for an order granting or
denying a motion for parenting time. Dismissal is without prejudice to the filing of a delayed application
for leave to appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court
rules and is not time-barred.
The motion to waive fees is GRANTED for this case only.
