Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V JOSEPH ANTHONY PAPARELLA
Docket No. 374870
LC No. 23-003822-FH
Mark T. Boonstra, Judge, acting under MCR 7.211(E)(2), MCR 7.217 and MCR 7.219(J)
orders:
The motion for reconsideration of this Court’s order of December 9, 2025 is DENIED. The
December 9, 2025 order denied a motion filed by appellant’s appointed counsel, which requested a 56-
day extension of time to file appellant’s brief from January 6, 2026 to March 3, 2026. Appellant’s counsel,
however, previously sought and secured extensions of 140 days from the original brief due date of August
19, 2025 to January 6, 2026. The requested additional 56-day extension “[d]ue to counsel’s current
caseload and deadlines in other matters,” was unreasonable in light of the time requirements for filing a
brief that are provided under the court rules and counsel’s prior extensions in this appeal.
This cause is now REMANDED to the trial court for the appointment of substitute counsel,
current counsel having failed to file appellant’s brief on appeal by the January 6, 2026 deadline.
The Clerk of the Court is directed to send a copy of this order to Keeley Blanchard,
Administrator of the Michigan Appellate Assigned Counsel System.
