Court of Appeals, State of Michigan
ORDER
OLA MAHMOUD MADY V HANY GAMAL FATHALLA ABOELNASER
Docket No. 379606
LC No. 24-002613-DM
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is DENIED. Nevertheless, pursuant to the policy of the Court,
payment of the $375 entry fee shall not be pursued by the Clerk of the Court because the appeal must be
dismissed for lack of jurisdiction.
The claim of appeal is DISMISSED for lack of jurisdiction. MCR 7.203(A)(1). The
February 4, 2026 order denying reconsideration is not a final order that can be appealed by right. Nye v
Gable, Nelson & Murphy, 169 Mich App 411, 415; 425 NW2d 797 (1988). Additionally, the December
15, 2025 judgment of divorce is not a final judgment that is appealable by right; it did not dispose of all
of the issues. MCR 7.202(6)(a)(i). Specifically, the child support issue was referred to the Friend of the
Court and remained unresolved when the claim of appeal was filed. Dismissal is without prejudice to the
filing of a late appeal under MCR 7.205(A)(4) provided such a filing meets all requirements under the
court rules and is not time-barred.
