Court of Appeals, State of Michigan
ORDER
ESTATE OF ALLEN S WALTANEN V SHAWN MOODY
Docket No. 379708
LC No. 2023-018127-CK
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The claim of appeal is DISMISSED for lack of jurisdiction. Appellant literally states that
she claims an appeal from a February 11, 2026 order denying motions for reconsideration. But that order
is plainly not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). Also, the underlying
December 19, 2025 order is not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). The
December 19, 2025 order is not a final order under MCR 7.202(6)(a)(1) because it does not dispose of all
claims in this case since it leaves plaintiff-appellant’s request for partition of the relevant property
unresolved. Dismissal is without prejudice to the filing of a delayed application for leave to appeal under
MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-
barred. Alternatively, appellant may be able to timely file a claim of appeal after entry of a final judgment
or order under MCR 7.202(6)(a)(i).
