The motion to waive fees is GRANTED for this case only.
The motion for immediate consideration is DENIED.
Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal,
the circuit court’s June 4, 2025 order is VACATED, and the matter is REMANDED for further proceedings
consistent with this order. After a prior remand by this Court, see People v Jones, unpublished order of the
Court of Appeals, entered October 16, 2023 (Docket No. 366583), the trial court entered an order on May
13, 2025, which granted a motion to appoint counsel, but did not name an attorney. Without ever naming
an attorney, the court then denied defendant’s motion for relief from judgment on June 4, 2025. This is in
violation of MCR 6.505(B): “If the court appoints counsel to represent the defendant, it shall afford counsel
56 days to amend or supplement the motion.” On remand, the trial court must appoint an attorney to assist
defendant in this matter consistent with its May 13, 2025 order, and provide counsel the opportunity to
amend or supplement the motion as required by the court rules, before adjudicating the motion for relief
from judgment. We further note that to the extent the trial court has held that defendant cannot seek relief
under People v Eads, ___ Mich App ___; ___ NW3d ___ (Docket No. 357332) (2025), lv gtd 25 NW3d
118 (September 18, 2025), because defendant was 18 years old at the time of the commission of the offense,
this Court has recently extended the holding of Eads to 18-year-old offenders. People v Echols, ___ Mich
App ___; ___ NW3d ___ (September 24, 2025) (Docket No. 370709), lv pending.
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
