Court of Appeals, State of Michigan
ORDER
IN RE WASLAWSKI
Docket No. 380722
Stephen L. Borrello, Chief Judge Pro Tem, acting under MCR 7.203(F)(1), orders:
The complaint for mandamus is DISMISSED for lack of jurisdiction. This Court has
original jurisdiction to hear complaints for a writ of mandamus, MCR 7.203(C)(2), but, because plaintiff
has directed the complaint to a lower court, this Court must treat the complaint as one for a writ of
superintending control. See MCR 3.302(C); People v Johnson, 345 Mich App 51, 59 (2022). This Court’s
jurisdiction over complaints for superintending control extends only to “a lower court or a tribunal
immediately below” this Court. See MCR 7.203(C)(1). The district court is not immediately below this
Court. As such, this Court does not have jurisdiction over this original action.
The motion to waive fees is DENIED as moot.
