Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V MATTHEW RYAN GRANT
Docket No. 380251
LC No. 16-007093-01-FC
Michael F. Gadola
Presiding Judge

Judges
The motions to waive fees are GRANTED for this case only.
The motion to “correct error in brief” is GRANTED, and the corrected brief in support of
the application is accepted.
The motions to “conduct evidentiary hearing” and to appoint counsel are DENIED.
The delayed application for leave to appeal is DENIED because defendant has failed to
establish that the trial court erred in denying the motion for relief from judgment. We note that the trial
court entered both an opinion explaining its reasoning and a separate written order denying the motion.
Contrary to the position taken in the prosecutor’s answer filed in this Court, the trial court did explain its
reasoning, doing so in its written opinion. Further, while the separate order refers to the motion as a
“successive” motion, that is a typographical error. The trial court’s written opinion makes clear that the
trial court addressed the motion under the framework of MCR 6.508(D), not MCR 6.502(G). A remand
for the purposes stated by the prosecutor in its answer to the delayed application is unnecessary.
