Judges
On the Court’s own motion, counsel for the parties are directed to be prepared at oral
argument to address whether this Court should dismiss this appeal for lack of jurisdiction as to plaintiff-
appellant Terry W. Strauser, where it appears that plaintiff-appellant Strauser died on October 9, 2023,
more than 16 months before the instant appeal was filed and no personal representative for his estate has
appeared in this appeal. Counsel for the parties are also directed to be prepared at oral argument to address
whether the statutory surplus-proceeds claim under MCL 711.78t raised by plaintiff-appellant Victoria
Sheffield is moot given the May 15, 2026 disbursement of the remaining proceeds to Sheffield. The
parties may file supplemental briefs, of no more than ten pages, addressing these issues, by June 1, 2026.
