Court of Appeals, State of Michigan
ORDER
MARY LOU ROGERS V JOHN FITZGERALD ROGERS
Docket No. 377821
LC No. 1998-000338-DM
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The motion to waive fees is GRANTED in this case only.
The claim of appeal is DISMISSED for lack of jurisdiction because the January 10, 2024
order appealed from is not a final order as defined in MCR 7.202(6). MCR 7.203(A)(1). The
postjudgment order regarding child support cannot be considered an order that grants or denies a motion
to change legal custody, physical custody, or domicile under MCR 7.202(6)(a)(iii). Dismissal is without
prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all
requirements under the court rules and is not time-barred.
