ORDER ACCEPTING REPORT AND RECOMMENDATION
OF UNITED STATES MAGISTRATE JUDGE
Before the Court is the Report and Recommendation of United States Magistrate Judge, filed
in the above-captioned cause on September 3, 2026. (ECF No. 46). To date, no objections to the
Report and Recommendation have been received.1
Because no party has objected to the Magistrate Judge's Report and Recommendation, the Court
need not conduct a de novo review. See 28 U.S.C. § 636(b)(1) ("A judge of the court shall make a de
novo determination of those portions of the report or specified proposed findings and recommendations
to which objection is made."). The Court has reviewed the Report and Recommendation and finds its
reasoning to be neither clearly erroneous nor contrary to law. United States v. Wilson, 864 F.2d 1219,
1221 (5th Cir.), cert. denied, 492 U.S. 918 (1989).

Case 5:25-cv-00318-FB Document 47 Filed 10/09/26 Page 1 of 2alternative, Motion for Voluntary Dismissal Without Prejudice (“Motion”) (ECF No. 42) is GRANTED in PART and DENIED in PART. Insofar as Plaintiff’s Motion asks the Court to reconsider the Magistrate Judge’s prior recommendation denying the motion to amend the pleadings out of time, the Motion is DENIED. However, insofar as the Motion requests to voluntarily dismiss this matter pursuant to Rule 41(a)(2), it is GRANTED and this case is DISMISSED WITHOUT PREJUDICE. The parties are explicitly granted the right to reuse all discovery and work product in the subsequent litigation. Accordingly, the pending Motion for Summary Judgment (ECF No. 25) is DENIED as MOOT without prejudice to re-urging the arguments therein at a later time or in a different case. IT IS FURTHER ORDERED that remaining motions pending with the Court, if any, are Dismissed as Moot and this case is now CLOSED. It is so ORDERED. SIGNED this 9th day of October, 2026. _________________________________________________ FRED BIERY UNITED STATES DISTRICT JUDGE . 2 Case 5:25-cv-00318-FB Document 47 Filed 10/09/26 Page 2 of 2
