AO 245B (Rev. 09/19) Judgment in a Criminal Case Not for Public Disclosure Attachment (Page 4) — Statement of Reasons DEFENDANT: LATRACE SHENAY CORNELIUS CASE NUMBER: 4:22CR40002-002 DISTRICT: WESTERN DISTRICT OF ARKANSAS STATEMENT OF REASONS VII. COURT DETERMINATIONS OF RESTITUTION A. Restitution Not Applicable. B. Total Amount of Restitution: $ C. Restitution not ordered: (Check only one) 1. For offenses for which restitution is otherwise mandatory under 18 U.S.C. § 3663A, restitution is not ordered because the number of identifiable victims is so large as to make restitution impracticable under 18 U.S.C. § 3663A(c)(3)(A). 2. For offenses for which restitution is otherwise mandatory under 18 U.S.C. § 3663A, restitution is not ordered because determining complex issues of fact and relating them to the cause or amount of the victims’ losses would complicate or prolong the sentencing process to a degree that the need to provide restitution to any victim would be outweighed by the burden on the sentencing process under 18 U.S.C. § 3663A(c)(3)(B). 3. For other offenses for which restitution is authorized under 18 U.S.C. § 3663 and/or required by the sentencing guidelines, restitution is not ordered because the complication and prolongation of the sentencing process resulting from the fashioning of a restitution order outweigh the need to provide restitution to any victims under 18 U.S.C. § 3663(a)(1)(B)(ii). 4. For offenses for which restitution is otherwise mandatory under 18 U.S.C. §§ 1593, 2248, 2259, 2264, 2327 or 3663A, restitution is not ordered because the victim(s)'(s) losses were not ascertainable (18 U.S.C. § 3664(d)(5)). 5. For offenses for which restitution is otherwise mandatory under 18 U.S.C. §§ 1593, 2248, 2259, 2264, 2327 or 3663A, restitution is not ordered because the victim(s) elected to not participate in any phase of determining the restitution order (18 U.S.C. § 3664(g)(1)). 6. Restitution is not ordered for other reasons. (Explain) D. Partial restitution is ordered for these reasons (18 U.S.C. § 3553(c)): VIII. ADDITIONAL BASIS FOR THE SENTENCE IN THIS CASE (If applicable) The Court determined that the applicable guideline range for in this case was excessive and a downward variance to a term of 46 to 57 months imprisonment was sufficient, but not greater than necessary, to comply with the factors of 18 U.S.C. § 3553(a). As for the nature and circumstances of the offense, the defendant was found in possession of both firearms after being convicted of a felony offense. The conduct in this case involved her codefendant and husband’s distribution of methamphetamine from their shared residence. The combination of guns and drugs increases the likelihood for violence. As for the defendant’s history and characteristics, she has some criminal history, and she has served a prior term of incarceration in a women’s center within the state of Texas. These sentences did not seem to have any impact on her behavior, based on his commission of these offenses. Nonetheless, the defendant appeared to have some mental health issues and substance abuse problems; therefore, she would likely benefit from receiving drug treatment while in the Bureau of Prisons. She would also benefit from mental health, educational, and vocational services while incarcerated. The Court took notice of the JSIN data regarding similarly situated defendants. The Court ruled that a term of 48 months was sufficient but not greater than necessary to comply with the factors of 18 U.S.C. § 3553(a). This sentence reflects the seriousness of the offense, promotes respect for the law, and provides just punishment for the offense. Defendant’s Soc. Sec.
