On August 22, 2013, this Court issued a Memorandum Opinion in the above-
captioned docket. Since that time, it has come to the Court's attention that, due to a
technical printing error, the footnotes in that opinion were not numbered properly
resulting in two numbers being skipped. As a result, the Court has corrected the
numbering of the footnotes, and it is HEREBY ORDERED that an Amended

Memorandum Opinion shall issue solely for the purpose of correcting the numbering of
