Part 1981. It is being conducted in accord with the Act, Regulations, and the Rules of Practice and Procedure for Administrative Hearings Before the Office of Administrative Law Judges (Rules of Procedure). 29 C.F.R. Third Amended Prehearing Order ¶ 9 (Dec. 31, 2026). On September 24, 2026, Attorneys Cecere, Donesky, and Beck with Stinson, LLP filed a Motion to Withdraw as Counsel for Respondent WBI Energy (Motion to Withdraw). The attorneys seeking to withdraw noted that Respondent WBI Energy (WBI) did not object to their request. They also noted that WBI’s new counsel would enter an appearance. On September 28, 2026, Attorney Schneider with Fredrikson & Byron, P.A. filed a Notice of Appearance. Given the upcoming hearing and prehearing deadlines, this Tribunal ordered Attorneys Cecere, Donesky, and Beck and Attorney Schneider to state whether granting the Motion to Withdraw will delay the hearing of this matter. Order Regarding Stinson LLP’s Motion to Withdraw as Counsel and the Notice of Appearance Filed by Fredrickson & Byron, P.A (Oct. 2, 2026).
2 On October 5, 2026, Counsel Schneider filed a Response to Order Regarding Stinson LLP’s Motion to Withdraw as Counsel (Response). Counsel Schneider states that he conferred with Counsel Donesky and, after doing so, reports that he does not anticipate that granting the Motion to Withdraw will delay the hearing. The Motion to Withdraw is GRANTED. It is SO ORDERED. W. EDEN FORT Administrative Law Judge
