# Judicial Council of the District of Columbia Circuit

In the Matter of

Judicial Council Complaint No. DC-16-90010

A CHARGE OF JUDICIAL
MISCONDUCT OR DISABILITY

## ORDER

BEFORE:
Garland*, Chief Circuit Judge; Henderson*, Rogers, Tatel, and Wilkins, Circuit
Judges; Howell, Chief District Judge; and Cooper*, Chutkan, and Moss, District
Judges.

By order dated April 22, 2016, Judge Henderson dismissed a complaint filed against a
Judge of the United States District Court for the District of Columbia. On June 30, 2016, the
Judicial Council received from complainant a petition for review of the order of dismissal.
Although the petition for review is untimely under Rule 18(b) of the Rules for Judicial-Conduct
and Judicial-Disability Proceedings, the Judicial Council expressly finds that exceptional
circumstances render application of Rule 18(b) in this proceeding manifestly unjust. See Rule 2,
Rules for Judicial-Conduct and Judicial-Disability Proceedings. Therefore, the petition for
review is accepted for filing. Upon consideration thereof, it is

ORDERED, by the Judicial Council, that the disposition is affirmed and the petition for
review is denied pursuant to Rule 19(b)(1) of the Rules for Judicial-Conduct and Judicial-
Disability Proceedings.

FOR THE COUNCIL:
EURO

ELIZABETH H. PARET
Circuit Executive

*Chief Circuit Judge Garland, Judge Henderson, and Judge Cooper did not participate in the
instant order.
