1 Die Beschwerde der Klägerin ist begründet. Die Revision ist zuzulassen. In einem Revisionsverfahren können voraussichtlich die von der Beschwerde aufgeworfenen Rechtsfragen geklärt werden, ob ein Recht zum Abbau von Bodenschätzen, das zum Schädigungszeitpunkt grundeigen war und nach Maßgabe von Art. 8 und Anlage I Kapitel V Sachgebiet D Abschnitt III Nr. 1 lit. a Einigungsvertrag als bergfreier Bodenschatz im Sinne des § 3 Abs. 3 BBergG gilt, ein Vermögenswert im Sinne des § 2 Abs. 2 VermG ist, und ob ein der Treuhandanstalt für diesen Bodenschatz verliehenes Bergwerkseigentum, das nach Maßgabe von Art. 8 und Anlage I Kapitel V Sachgebiet D Abschnitt III Nr. 1 lit. d Einigungsvertrag als Bergwerkseigentum im Sinne des § 151 BBergG aufrechterhalten worden ist, ein dem früheren grundeigenen Abbaurecht im Wesentlichen entsprechendes Recht darstellt, das als rückgabefähiger Vermögensgegenstand im Sinne des § 6 Abs. 6a Satz 1 VermG anzusehen ist, sowie ob die Rückübertragung eines solchen Bergwerkseigentums gemäß § 4 Abs. 1 Satz 1 VermG von der Natur der Sache her ausgeschlossen ist.
