Gründe

1 Die Beschwerde hat Erfolg. Die Rechtssache hat die vom Kläger dargelegte grundsätzliche Bedeutung (§ 132 Abs. 2 Nr. 1 VwGO). Das Berufungsgericht hat die Prüfung der Verhältnismäßigkeit der angefochtenen kommunalaufsichtlichen Verfügung für unerheblich gehalten und deshalb offengelassen, ob die von ihm angenommene Haushaltsnotlage des Klägers darauf zurückzuführen ist, dass der Beklagte seinerseits seiner Verpflichtung aus Art. 137 Abs. 5 Hessische Verfassung, den Gemeindeverbänden die zur Durchführung ihrer eigenen und der übertragenen Aufgaben erforderlichen Geldmittel zu sichern, nicht nachkommt (UA S. 17). Im Revisionsverfahren wird zu klären sein, ob diese Rechtsauffassung mit der Garantie der kommunalen Selbstverwaltung gemäß Art. 28 Abs. 2 Satz 2 GG vereinbar ist.
