Omnilex summary

The Federal Administrative Court upheld the complaint against denial of leave to appeal. It held that the case has fundamental importance because revision may clarify the scope of correcting obvious errors under Art. 19 of Regulation 796/2004 and the identical successor provision in Art. 21 of Regulation 1122/2009. The court also noted, for the provisional value in dispute, that the claimed OGS approvals concern whether and to what extent an operating premium can be granted for an 11.4 ha asparagus area in 2005.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; revision leave may be granted where the case raises a question of fundamental importance requiring further clarification in the revision instance. The scope of the correction of obvious errors under Art. 19 VO (EG) 796/2004 and the identical successor provision in Art. 21 VO (EG) Nr. 1122/2009 is capable of being clarified in revision, particularly where the lower court's assessment turns on the application of those provisions to subsidy applications. For provisional amount in dispute, the economic significance may be determined by the number and value of the payment entitlements affected (consid. 1-2).
