Gründe

1 Die Beschwerde der Beigeladenen ist begründet. Die Revision ist gemäß § 132 Abs. 2 Nr. 1 VwGO zuzulassen. In einem Revisionsverfahren kann voraussichtlich die mit der Beschwerde sinngemäß bezeichnete - entscheidungserhebliche und rechtsgrundsätzliche - Frage geklärt werden, ob das Vermögensamt zur Entscheidung über die Höhe des nach § 6 Abs. 6a Satz 3 VermG herauszugebenden Erlöses und eines nach § 6 Abs. 6a Satz 2 VermG im Gegenzug zu zahlenden Ablösebetrages auch dann verpflichtet ist, wenn über die Höhe des herauszugebenden Erlöses zwischen dem Berechtigten und dem Verfügungsberechtigten Streit besteht, oder ob das Vermögensamt sich in derartigen Fällen auf eine Entscheidung dem Grunde nach zu beschränken und die Beteiligten im Übrigen auf den Zivilrechtsweg zu verweisen hat. Diese Frage ist klärungsbedürftig, nachdem sie vom Verwaltungsgericht im ersteren Sinne, von anderen Gerichten, namentlich vom Bundesgerichtshof - wenngleich nicht unmittelbar zu § 6 Abs. 6a VermG (vgl. Urteil vom 16. Juli 1999 - V ZR 129/98 - BGHZ 142, 221; Beschluss vom 8. Mai 2002 - V ZB 32/01 - BGHZ 151, 24) - hingegen im letzteren Sinne beantwortet wird.
