Omnilex summary

The Federal Administrative Court allowed the defendant's and intervening party's complaints against the non-admission of revision in a public transport licensing case. It held that the matter has fundamental importance because it remains open whether public transport interests under § 13(2) No. 2 PBefG are affected when the planned service is jeopardized by an expected operating deficit and whether a contested claim for deficit compensation by a third party must be taken into account.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance in a line-transport licensing dispute. Fundamental importance exists where a previously unresolved question of law is capable of clarification in the revision proceedings and is decisive beyond the individual case. This applies in particular to the interpretation of public transport interests under § 13 Abs. 2 No. 2 PBefG where it is unclear whether an expected operating deficit jeopardizing the planned service constitutes a relevant impairment and whether a disputed compensation claim by a third party must be considered in that assessment (consid. 1).

Key legal question

Whether revision should be admitted for fundamental importance under § 132(2) No. 1 VwGO concerning § 13(2) No. 2 PBefG.

Extracted holding

Yes. The case raises a fundamental question whether public transport interests are impaired when the planned line operation is threatened by an expected deficit, and whether a disputed third-party compensation claim must be considered.

Extracted reasoning

The question is not yet clarified in case law and is relevant beyond the individual case, so the appeal for leave to appeal could likely provide the Federal Administrative Court with an opportunity to clarify it.
