Omnilex summary

The Federal Administrative Court granted the complaint and admitted revision. The court held that the case is of fundamental importance because it may clarify whether, in addition to Section 82 AufenthG, a foreigner's declaration to the immigration authority can create disclosure obligations and what consequences a breach of such an obligation may have for the acquisition of rights under Art. 6 ARB 1/80.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance in residence-law disputes: Fundamental importance exists where the appeal court decision raises a question requiring clarification in revision. This may be the case where it remains open whether, beyond the statutory disclosure duty under § 82 AufenthG, an alien's separate declaration to the immigration authority can establish comparable disclosure obligations and, if so, what consequences a breach may have for the acquisition of rights under Art. 6 ARB 1/80. The complaint proceedings are confined to assessing whether such clarifying questions warrant revisional review (consid. 2).
