Omnilex summary

The Federal Administrative Court upheld the complaint of the intervening party against the denial of revision. It found a divergence under § 132(2) no. 2 VwGO because the administrative court had used the date of effectiveness of the allocation decision as the starting point for the two-year period in § 2(5) sentence 1 VZOG, whereas the Senate's case law requires the date of finality. On that basis, revision was admitted.

Omnilex headnote

Key legal question

Whether the administrative court judgment diverged from BVerwG case law on the start of the two-year period under § 2(5) sentence 1 VZOG.

Extracted holding

Yes. The Federal Administrative Court held that its case law starts the two-year period with the finality of the decision, whereas the lower court wrongly relied on the decision's effectiveness.

Extracted reasoning

The lower court adopted a legal proposition inconsistent with prior decisions of the Senate, thereby satisfying the divergence ground under § 132(2) no. 2 VwGO.

Key legal question

Whether revision should be admitted.

Extracted holding

Revision was admitted because the complaint was well-founded on the divergence ground.

Extracted reasoning

A deviation from established highest-court case law warranted admission of the revision.
