Omnilex summary

The Federal Administrative Court upheld the plaintiff's complaint against the refusal to admit revision. It held that the case has fundamental significance because it can clarify whether constitutional guarantees of academic freedom, occupational freedom, and proportionality limit the interpretation of 'unworthy conduct' under Baden-Württemberg higher education law governing revocation of an academic degree.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a complaint against non-admission of revision concerning revocation of an academic degree for 'unworthy conduct'; the case is of fundamental significance where it may clarify whether and how Art. 5(3) sentence 1 GG, Art. 12(1) sentence 1 GG and the principle of proportionality constrain the interpretation of the statutory concept. For § 35(7) sentence 1 LHG BW, a science-related understanding of unworthiness may require constitutional delimitation (consid. 1).
