Omnilex summary

The Federal Administrative Court upheld the plaintiff’s complaint against the VG Greifswald judgment and admitted the revision. It held that the case presents a question of fundamental importance under § 132 Abs. 2 Nr. 1 VwGO. The pending revision can clarify whether § 2 Abs. 1 sentence 6 VZOG presupposes a complete agreement concerning a specific asset or whether an agreement on general allocation principles for a class of assets is sufficient.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance; scope of § 2 Abs. 1 sentence 6 VZOG. A question of fundamental importance exists where the appeal court must clarify a legally unsettled issue of general significance. Under § 2 Abs. 1 sentence 6 VZOG, it is open whether the provision requires agreement of the parties on a specific object of restitution/assignment or whether an agreement on allocation principles for a defined category of assets suffices. The need for clarification in the revision procedure supports admission when the legal question is capable of recurring and is decisive for the dispute (consid. 1).
