Gründe

1 Die Beschwerde der Beklagten hat Erfolg. Der Rechtssache kommt grundsätzliche Bedeutung im Sinne von § 132 Abs. 2 Nr. 1 VwGO zu. Die Beschwerdebegründung führt auf die klärungsbedürftigen Fragen,

ob die Prüfung der tatsächlichen Ausgestaltung des staatlichen Sportwettenmonopols hinsichtlich der Werbung am Maßstab des unionsrechtlichen Kohärenzerfordernisses bundeseinheitlich oder wegen der vom Grundgesetz gewährleisteten Eigenständigkeit der Länder (Art. 20 Abs. 1, Art. 79 Abs. 3 i.V.m. Art. 23 Abs. 1 Satz 3 GG) länderspezifisch zu erfolgen hat, und

ob die Vereinbarkeit des staatlichen Sportwettenmonopols mit dem unionsrechtlichen Kohärenzerfordernis von einer Folgenabschätzung im Sinne einer Wanderbewegung hin zu liberaler geregelten anderen Glücksspielbereichen abhängt.

2 Auf die Zulassungsgründe des § 132 Abs. 2 Nr. 2 und 3 VwGO kommt es im Hinblick auf die erfolgreiche Grundsatzrüge nicht an.
