Gründe

1 Die Beschwerde der Beklagten ist begründet. Die Revision ist gemäß § 132 Abs. 2 Nr. 1 VwGO wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen.

2 Das Revisionsverfahren kann Gelegenheit geben, die Frage zu klären, ob und gegebenenfalls unter welchen Voraussetzungen die Eingriffswerte der AVV-Baulärm im Rahmen eines Schutzanspruchs aus § 74 Abs. 2 Satz 2 VwVfG i.V.m. § 22 Abs. 1 Satz 1 BImSchG geeignet sind, die Zumutbarkeitsgrenze für Lärm im Außenkontaktbereich von Ladengeschäften zu bestimmen.
