Gründe

1 Die Beschwerde hat Erfolg. Der Rechtssache kommt die von der Klägerin geltend gemachte grundsätzliche Bedeutung zu (§ 132 Abs. 2 Nr. 1 VwGO). Im Revisionsverfahren wird voraussichtlich zu klären sein, ob § 6 Abs. 6a Satz 3 Alt. 3 VermG analog anzuwenden ist, wenn einem Unternehmensträger nicht ein Unternehmen, sondern ein einzelner Vermögensgegenstand entzogen worden ist, dieser dem Unternehmensträger aber deshalb nicht zurückgegeben werden kann, weil er zwischenzeitlich untergegangen ist und mangels Quorum auch nicht wiederbelebt werden konnte.

2 Das Verwaltungsgericht hat zugunsten der Klägerin unterstellt, dass die Firma A. AG im Jahr 1935 dadurch im Sinne von § 1 Abs. 6 VermG geschädigt wurde, dass sie das hier streitbefangene Grundstück an Dritte verkauft hat. Die Firma A. AG könnte daher, wenn sie noch bestünde, Rückgabe des Grundstücks oder Herausgabe des Veräußerungserlöses nach den allgemeinen Vorschriften verlangen. Da die Firma A. AG jedoch nach den Feststellungen des Verwaltungsgerichts im Jahre 1982 erloschen ist, kann sie diese Ansprüche nur geltend machen, wenn sie zuvor nach Maßgabe des § 6 Abs. 1a VermG wiederbelebt wurde; dass diese Vorschrift auf Ansprüche eines Unternehmens(trägers) auf Singularrestitution entsprechend anzuwenden ist, ist in der Rechtsprechung des Bundesverwaltungsgerichts geklärt (Urteil vom 19. September 2002 - BVerwG 7 C 18.02 - Buchholz 428 § 6 VermG Nr. 51). Der vorliegende Fall bietet Anlass zu der Prüfung, ob und in welchem Sinne diese Rechtsprechung fortzuentwickeln ist, wenn das Quorum nicht erreicht wurde. Dies betrifft die - ggf. ebenfalls analoge - Anwendbarkeit von § 6 Abs. 6a Satz 3 Alt. 3 VermG sowie in diesem Zusammenhang auch die Frage, wer die hiernach "Berechtigten" sind, namentlich ob hierzu auch solche früheren Anteilseigner zählen, die ihrerseits aufgrund einer schädigenden Maßnahme aus dem Unternehmen(sträger) verdrängt worden waren.
