Omnilex summary

The Federal Administrative Court allowed the plaintiff's complaint and admitted revision. The case concerns whether a purchaser of land, protected by a priority notice in the land register and having timely raised objections, is entitled to bring an action against a plan approval decision that affects parts of the purchased property. The court treated this as a question of fundamental importance under Section 132(2)(1) VwGO. It also provisionally set the value in dispute for the revision proceedings under the GKG provisions cited.

Key legal question

Whether a purchaser with a registered priority notice who timely objected has standing to challenge a plan approval decision affecting the purchased land.

Extracted holding

The legal question is of fundamental importance and warrants clarification in revision proceedings.

Extracted reasoning

The court held that the complaint was admissible and well-founded because the case raises a general question under Sections 132(2)(1) and 42(2) VwGO about the purchaser's standing; revision was therefore to be admitted.

Key legal question

Whether leave to appeal should be granted due to fundamental importance.

Extracted holding

Revision is admitted on the ground of fundamental importance.

Extracted reasoning

The court found that the proposed revision could clarify whether the purchaser's position and priority notice confer standing to sue against the plan approval decision.
