Gründe

1 Die Beschwerde des Klägers hat Erfolg. Die Rechtssache hat grundsätzliche Bedeutung im Sinne des § 132 Abs. 2 Nr. 1 VwGO. Das Revisionsverfahren kann Gelegenheit zur Klärung der Frage bieten, ob es nach der Zulassung des Versandhandels mit Arzneimitteln durch das Gesetz zur Modernisierung der gesetzlichen Krankenversicherung vom 14. November 2003 (BGBl I S. 2190, 2249 ff.) mit Art. 12 Abs. 1 und Art. 3 Abs. 1 GG vereinbar ist, dass nach § 17 Abs. 3 der Apothekenbetriebsordnung auch nicht verschreibungspflichtige apothekenpflichtige Arzneimittel nicht im Wege der Selbstbedienung in den Verkehr gebracht werden dürfen.
