1 Die Beschwerde hat Erfolg. Der Rechtssache kommt grundsätzliche Bedeutung zu (§ 132 Abs. 2 Nr. 1 VwGO), was vom Kläger noch hinlänglich dargelegt wird. Im Revisionsverfahren wird voraussichtlich zu klären sein, ob der Grundsatz der Chancengleichheit der politischen Parteien (Art. 21 Abs. 1 Satz 1, Art. 28 Abs. 1 Satz 1 und 2 GG) es zulässt, ein Kommunalwahlgesetz eines Landes so auszulegen, dass eine politische Partei im Verfahren der Wahlprüfung zwar die Rechtswidrigkeit, nicht aber die Rechtmäßigkeit einer Kommunalwahl geltend machen darf.
