Nachträgliche Bewilligung von Prozesskostenhilfe

Gründe

1 Die Voraussetzungen für die Bewilligung von Prozesskostenhilfe und die Beiordnung eines Rechtsanwalts sind nicht gegeben (§ 166 VwGO i.V.m. §§ 114, 121 Abs. 1 ZPO). Durch Prozesskostenhilfe soll der bedürftigen Partei die "beabsichtigte" Rechtsverfolgung oder Rechtsverteidigung ermöglicht werden (§ 114 Satz 1 ZPO). Nach der Beendigung eines Rechtszugs ist eine nachträgliche Bewilligung daher nur möglich, wenn der Antragsteller vor Abschluss des Verfahrens einen Prozesskostenhilfeantrag gestellt und alles zur Bewilligung von Prozesskostenhilfe Erforderliche getan hat (Beschluss vom 1. Juli 1991 - BVerwG 5 B 26.91 - Buchholz 310 § 166 VwGO Nr. 23). Vorliegend hat die Klägerin ihren Prozesskostenhilfeantrag zwar in der mündlichen Verhandlung vor Abschluss des das Revisionsverfahren beendenden Vergleichs gestellt, diesem aber entgegen § 117 Abs. 2 ZPO keinerlei Belege beigefügt.
