Omnilex summary

The Federal Administrative Court upheld the defendant’s complaint against non-admission of revision in a municipal self-government dispute. It found the case to have fundamental importance under § 132(2) No. 1 VwGO because it may need to be clarified whether, for reviewing the form of a first decision as shaped by the objection decision, it matters that the first decision was substantively made not by the authority itself but by a private-law legal entity. The court also set a provisional value of the dispute for the revision proceedings.

Omnilex headnote

Key legal question

Whether revision should be admitted for fundamental importance under § 132(2) No. 1 VwGO.

Extracted holding

Yes. The complaint is admissible and well-founded; revision is admitted because the case raises a question of fundamental importance requiring clarification.

Extracted reasoning

The Federal Administrative Court held that it may clarify whether, when a first decision is substantively attributable not to the issuing authority but to a private-law legal entity acting in municipal self-government matters, the assessment must also be based on the form that the first decision takes after the objection decision.
